Council Proceedings 3 <br />City of New Brighton <br />Sept. 11, 1974 <br />I-lotion by Fisher, seconded by Eagon to waive reading ORDINANCE <br />of ordinance and to hold second reading and adopt #338 <br />an ordinance entitled AN ORDINANCE AMENDING ORDINANCE <br />NO. 188, BEING THE NEV BRIGHTON ZONING ORDINANCE BY <br />ZONING CERTAIN PROPERTY IN THE CITY OF NEW BRIGHTON <br />5 ayes - 0 nayes - carried <br />Motion-.by Eagon, seconded by Fisher to direct <br />City Clerk to withhold publication of rezoning ordinance <br />#338 until attorney has reviewed and approved covenant to <br />subject property which stipulates that property must be <br />developed as a tennis facility or with single family <br />residences on that portion of property formerly zoned <br />R-1 and with single or two-family residences on that <br />portion formerly zoned R-2 and after such approval <br />petitioner provide proof of recording of such covenant <br />5 ayes - 0 nayes - carried <br />Council took no action on propsed resolution granting <br />variance VN-129 and special use permit SP-53 <br />Motion by Anderson, seconded by Eagon to receive <br />report from City Sanitarian, dated August 26, 1974. <br />5 ayes - 0 nayes - carried Elsa Karol <br />Motion by Bromander, seconded by Rebelein to grant ;ewer Waiver <br />one-year waiver to connect to sanitary sewer, Elsa <br />Karol <br />5 ayes - 0 nayes - carried <br />Public Hearings <br />Attorney stated hearing was properly called. <br />Mr. Keith Harstad, owner of the property, was <br />present to answer council questions. VN-126 <br />Mr. Harstad noted that any change to the premises <br />could potentially break the lease with 7-Eleven. 9:24 to <br />He noted that in his judgment health and welfare 9:59 <br />could best be served by leaving property as it is. <br />Petitioner was questioned as to whether a traffic <br />study had been conducted. Mr. Harstad indicated <br />that this had not been done. He further indicated <br />that he felt any change would worsen traffic <br />circulation. <br />Motion by Rebelein, seconded by Eagon to close Close <br />hearing Hearing <br />5 ayes - 0 nayes - carried
