<br />The council also approved a motion to advise the petitioner that <br />closing of some driveways will be a consideration of the council <br />at the time_of the variance hearing. <br />At this meeting the council authorized a permit to install a pylon <br />sign with certain condition <br />4. November 13 1973: Council approved a temporary certificate of <br />occupancy subject to receipt of a $1000 bond for completion of <br />landscape and site work. <br />5. December 11-, 1973: Public hearing was held relative to the variance <br />request. (R.C. Ernst presented a plan which he requested the <br />variance be based. This plan proposed essentially the same site <br />plan as the project was actually constructed. Angle parking was <br />shown, on the Silver Lake Road side of the project, 4 fewer'-in <br />number than indicated on the original site plan.) <br />The council received a letter from the Southland Corporation which <br />stated that in accordance with the terms of the lease 7-Eleven could <br />terminate the lease and could also claim damages from the <br />"condemning authority" but not from the lessor. <br />Action was deferred on the variance and the council asked the <br />petitioner to have a traffic analysis done. This action was <br />reconsidered later in the meeting with a motion stipulating that <br />the traffic analysis should contain several alternate traffic and <br />parking plans with statements as to their strengths and weaknesses. <br />6. Februar 12 1974: A motion:was approved to notify Mr. Ernst that <br />the, traffic report was to be submitted by February 26, 1974 or <br />Mr. Ernst should document to the council why the report is not <br />:complete, the time the traffic consultant was hired, and problems <br />the traffic consultant had encountered. The motion further advised <br />the petitioner that if there were no good reason for delay the <br />council may order a study at the owner's expense. <br />7. February 26',. 1974: The council received a traffic report from <br />Jack Anderson Associates. ,(The report contained three layouts. <br />The first two maintained right angle parking and had a 3 ft green <br />strip on Silver Lake Road. The difference in layouts was the <br />opening of a 10 ft driveway to the east of the building. The third <br />layout had an 8 ft. landscaped strip, <br />parking on the west side of the buildiOrie-way driveway, and angular <br />the most westerly exit on County Road E. Thelrethree port notedtthisosed <br />driveway would interfere with county Road E traffic and should not <br />exist.)
