PUBLIC HEARING <br />VN-135 <br />December 10, 1974 <br />8:05 P.M. <br />Request: Variance from Section 10-010 (f) to allow creation of lot <br />with less than 75' width and variance from Section 10-010 <br />(e) to divide. lot leaving existing house with less than <br />required 5' sideyard setback. <br />Applicant: Cecil Norberg <br />Location: 2$80 Mississippi Street (northwest quadrant of <br />Mississippi Street anc~ Leona Drive) <br />Discussion• <br />The applicant owns a large lot at the above location which <br />is approximately twice the size of a minimum sized single family <br />lot as required by the Zoning Code. The applicant wishes to <br />divide his property into two lots and will be requesting the <br />Council to approve a minor subdivision for this purpose. The <br />proposed division is shown on the attached surveys. <br />The proposed division violates two Zoning. Code requirements <br />and for this reason a variance will have to be approved before <br />the division can be approved. The first deviation from Code is <br />that the corner lot would not have the 75' width required by <br />Section 10-010 (f). While the total property has sufficient <br />width that it could have been subdivided into two lots of <br />adequate size, an additional 9' street easement was taken for <br />Leona Drive leaving only about 66' of width for the corner lot. <br />The second aspect of the variance is that the land division, <br />as proposed, would leave the existing house without the 5' side <br />yard setback required by Section 10-010(e). The need for this <br />variance (or a variance on width) would have .existed in any case <br />and is not the result of the additional 9' easement on Leona <br />Drive. <br />We see two alternatives with regard to this second part <br />of the variance. Either the division line could be moved farther <br />to the east to give the existing house adequate setback and the <br />corner lot less width, or a covenant could be required on the <br />deed limitng any house constructed on the corner lot to not <br />less than a 10' setback from the existing house. If the <br />potential 1.3' reduction in the distance between the two houses. <br />is not of concern, the variance could be approved as requested. <br />
