PUBLIC HEARING
VN-135
December 10, 1974
8:05 P.M.
Request: Variance from Section 10-010 (f) to allow creation of lot
with less than 75' width and variance from Section 10-010
(e) to divide. lot leaving existing house with less than
required 5' sideyard setback.
Applicant: Cecil Norberg
Location: 2$80 Mississippi Street (northwest quadrant of
Mississippi Street anc~ Leona Drive)
Discussion•
The applicant owns a large lot at the above location which
is approximately twice the size of a minimum sized single family
lot as required by the Zoning Code. The applicant wishes to
divide his property into two lots and will be requesting the
Council to approve a minor subdivision for this purpose. The
proposed division is shown on the attached surveys.
The proposed division violates two Zoning. Code requirements
and for this reason a variance will have to be approved before
the division can be approved. The first deviation from Code is
that the corner lot would not have the 75' width required by
Section 10-010 (f). While the total property has sufficient
width that it could have been subdivided into two lots of
adequate size, an additional 9' street easement was taken for
Leona Drive leaving only about 66' of width for the corner lot.
The second aspect of the variance is that the land division,
as proposed, would leave the existing house without the 5' side
yard setback required by Section 10-010(e). The need for this
variance (or a variance on width) would have .existed in any case
and is not the result of the additional 9' easement on Leona
Drive.
We see two alternatives with regard to this second part
of the variance. Either the division line could be moved farther
to the east to give the existing house adequate setback and the
corner lot less width, or a covenant could be required on the
deed limitng any house constructed on the corner lot to not
less than a 10' setback from the existing house. If the
potential 1.3' reduction in the distance between the two houses.
is not of concern, the variance could be approved as requested.
