<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October 13, 1987 <br /> <br />LeFevere also talked to the legal staff at League of Minnesota <br />Cities who concurred with the Commission's staff. LeFevere stated <br />it is not safe to assume, unless you get an attorney general IS <br />opinion to that affect, that the city can issue off-sale licenses <br />as long as it stays in the business. <br /> <br />Blomquist asked if the city is in the process of obtaining the <br />opinion; Sinda stated it would seek the opinion if council so de- <br />sires. <br /> <br />Benke stated, pending receipt of an oplnlon from the Attorney Gen- <br />eral 's Office, council is not in a position to make a decision this <br />evening on the liquor portion of the proposal; and stated, if the <br />proposal is contingent on the liquor portion, he would have to <br />understand why. <br /> <br />Parkhill stated he is prepared and has a proposal to buy the <br />Brandywine, which would take the city out of the liquor business. <br /> <br />Sinda felt if the city got the right price it should sell the li- <br />quor operation. <br /> <br />Benke indicated he is aware of the option and the offer and stated <br />the council has not had the opportunity to discuss it; however, <br />Benke understands the offer is not high enough <br /> <br />Locke stated the city works through development proposals to see if <br />they are appropriate to the given area, see if the economics make <br />sense in terms of the city's redevelopment objectives and policies, <br />and then proceed with bringing the proposal to council for action. <br />Locke sees no reason to not continue working with Parkhill with re- <br />gard to a shopping center downtown. The current information in his <br />proposal makes it difficult to decide whether or not we are in a <br />position to enter into an exclusive arrangement; sees no reason or <br />need to take a specific action tonight on the proposal. <br /> <br />Sinda agrees, but stated Parkhill has put in a lot of time and <br />Sinda hopes Parkhill can put together a good project. <br /> <br />Benke stated he would like to see the lumberyard included in a de- <br />velopment plan because he believed if it is excluded there may be <br />room for conflict or incompatibility. <br /> <br />Parkhill stated the Stark's, owners of the lumberyard, have been in <br />business for a long time and want to do their own thing; and indi- <br />cated he can go 10,000 square feet less and fence off the lumber- <br />yard. <br /> <br />Williams asked when council would find out what the center's uses <br />will be; Parkhill listed the services for which he;s seeking ten- <br />ants. <br /> <br />Page 5 <br />
