NtnT <br />` Discussion° <br />The applicant is requesting a variance from Section 10-120 (d) <br />to have Less than the required 60' landscaped str~.p in the portion <br />of the street side yard which borders 5th St. NW and is across <br />from a residential district. The second part of the request <br />is for a variance .from Section 12-045 (e) to allow substitution <br />of a chain link fence for concrete curbs along the landscape strip <br />on the north side of the property. <br />The wording of the variance request is a bit confusing (see <br />attached) but we understand it to call for providing a 25' landscaped <br />area along that part of the north property- line east of the proposed <br />building. The official notice of this hearing follows our under- <br />standing of the request. You will note, however, that there is an <br />indentation on the north property line and that in this area the <br />landscape strip is reduced to approximately 5 feet. This does not <br />correspond to the application nor does it correspond to the public <br />hearing notice. The applicant would either have to revise his <br />request or revise his site plan. He has chosen to revise his site. <br />plan and on the plan submitted a second lighter line is shown labelled <br />"present requested setback". This line extends the 25 foot buffer <br />strip around the indentation in the lot line and the applicant would <br />then have to move his parking to the south in order to be inside <br />the fence that would then follow the configuration of the revised <br />landscaped strip. This revision would conform to the wording of <br />the variance request. and of the public`hearing notice. We would also <br />note that. in the event the variance were denied and the applicant <br />constructed according to code requirements, the b0 foot landscaped <br />
