o,~~ <br />A <br />,D <br />s- <br />: jj ~z,~ p1 <br />Public Hearing ~D-~ <br />Variaizce, VP~'R=143 <br />August. 12, _175 <br />Request: VN~-143, request to allow construction of a 5~ toot privacy <br />fence extending into front yard with.-setback of no less <br />than 68 feet from front property line <br />At~~lcant: :William Sherman <br />Lc-cation: 2163 29th Ave. NEST <br />Discussion: <br />The property in question has its ..side lot line abutting.,.one <br />of the `busier streets in the City, Mississippi Street, and the <br />applicant wishes to erect a fence in order, to buffer himself from <br />the `noise and activity of that. street. -At .the present time, the lot <br />across 2.9th Ave, to the west is undeveloped and the.. property to the: <br />east abutting. the property, in question is also undeveloped., The <br />property to the east has a small strip zoned R-2 immediately adjacent <br />to the applicant's property which was apparently intended at one <br />"time to be developed with a row of housing,. however,. this parcel is <br />joined to a larger area farther to the east which is zoned commercial. <br />In the past, development applications that have been made to .the City.. <br />in'this area .have included the area immediately adjacent to the <br />,applicant's property as .part of the larger area in the development <br />plans. What this implies is the possibility that the area immediate l~ <br />- to the east would not be built on with a typical single family horse <br />or a duplex with the 30 foot setback but might be part of a larger <br />development, perhaps, having somewhat larger setbacks. In thia <br />case, the existence of a fencejetting out beyond the 30-foot setback <br />on Mississippi Street would be less of a problem. <br />-The fence is, however, allowed a 15 foot setbac;{ from Miss. <br />Street under Code and whether .the variance is granted or not, the <br />applicant could have a fence in this location. The variance <br />itself pertains simply to the extention of the fence, forward of <br />the front line of the house into the front yard. In this case, <br />the applicant's house sits farther back than the house immediately <br />to the south and it is the applicant's intention to only extend <br />the fence as far forward as the front of his neighbor's garage. <br />This would then help to maintain the continuity of alignment <br />dawn the street. The house has a very large setback. from 29th Ave. <br />and the fence, as proposed to be located, would-not interfere at <br />all with adequate sight distance at the intersection of 29th A.ve. <br />and Mississippi. Street. <br />
