Council Proceedings 2 <br />City of New Brighton <br />September 9, 1975 <br />Motion by Fisher, seconded by Eagon to direct City <br />Attorney to submit letter requesting Attorney <br />General opinion to the State Attorney General with the <br />amendment that under Question 5, must building <br />inspector be part of the Board of Appeals and <br />addition to Question 8 - must the Fire Chief be <br />a member of the Board of Appeals and the addition of other <br />questions relating to whether Chapter 2, appendix B are <br />or are not mandatory. <br />5 ayes - 0 ayes - carried <br />Publis Hearings <br />Attorney stated hearing was properly called <br />No one appeared regarding proposed assessment <br />Motion by Fisher, seconded by~Eagon to close 8:46 to <br />hearing 8:50 <br />5 ayes - 0 nayes - carried <br />Motion by Rebelein, seconded by Eagon to waive reading <br />of resolution and to adopt resolution entitled <br />RESOLUTION ADOPTING t~3SSESSMENT OF CHARGES FOR DISEASED RESOLUTION <br />TREE REMOVAL X1602 <br />5 ayes - 0 nayes -carried <br />Attorney stated hearing was properly called <br />Mr. E. Hanson, manager of E-Z Mini Storage VN-146 E-Z <br />was present. Mini <br />Motion by Rebelein, seconded by Eagon to close <br />hearing. <br />5 ayes - 0 nayes - carried 8:51 to <br />Motion by Eagon, seconded by Fisher to find a 9:12 <br />hardship exists and that the variance is in <br />compliance with the purpose and intent of <br />Chapter XIV of the Zoning Code and to approve <br />VN-146 subject to the following conditions: <br />1. That the variance apply to the proposed sign <br />on 5th Street N.V3., signed by the Building and <br />Planning Coordinator and dated 9/9/75; <br />2. That such sign on 5th Street be made to <br />6 panels on each side; <br />3. That such sign on 5th Street be setback 132 feet <br />from the property line on 5th Avenue <br />4. That no variance be granted for the sign on I-35t~7; <br />5. That all other signs on the property be removed <br />with the exception of small wall signs on the interior <br />of the project that are not legible-from 5th Street N.t~7. <br />or 35Vd; <br />6. That such variance terminate upon subdivision or <br />additional building or construction on the property; <br />7. That certified excerpts of the minutes be recorded with <br />the property <br />5 ayes.- 0 nayes - carried <br />
