t -
1 ~
Discussions
The property in question is a building~of multiple occupancy ,
having individual entrances. Eddie's Cornea $ar and New Brighton
Furniture are the. two tenants. in the building. Bath businesses.,
have frontage. on both 10th Sto and 5th-Ave. NW. The basic
regulations governing this .type of building arecontaned in
section l~?--200 (c) (1) . Basically,. these regulations provide that
each business may have a single wall-sign to identify. it and that
there may be a ground signto.dentify the building or the center
as a'whale.. Individual wa L1 signs .then would be limited to 5 items
of information.: Other general regulations in the. ordinance covering
the percentage of signable area that 'may be covered and the size
-and height of the ground signs would also continue to govern in
this `case.
The applicant has already illegally erected a wall sign on
the 5th Ave. side of his business. The variance request. is to
.allow this: existing illegal sign to remain and be legally
- established and also to erect a new sign on the 10th St. side. in
the area where there is currently a painted sign saying "Furniture"
-.and lastly, to repaint the existing ground sign along-side the
building on the 5th Ave. side in accordance with the drawing that
the applicant has submitted. The variance is required for two
-basic reasons:
le There area large number of non-conformities in the
existing signing on the property and we cannot issue a permit for
a new sign unless either a variance is granted or all of the
'existing signing is made to conform to-.the ordinance.
2. The wall sign on 5th Ave: NW and .the ground sign do not.
themselves conform to he Zoning Code requirements.
The wall--sign on 5th .Ave. NTnT has an area of approximately 70 square
feet and is placed in a signable area where the"maximum"size
allowed would be 41 feet. Tn addition, the ground .sign with. an
8 foot setback is 2 feet less than the minimum setback allowed
•by Code. The sign itself exceeds in area the maximum size
permitted and the sign itself generally is not allowed because
it doesn't identify strictly the building. It is an identification -
sign for one of the businesses located in the building.
