PAUL, MINNESOTA 55144 .• ~ Phone (612) 646-7129 July 14, 1976 Members of City Council Members of Planning Commission City of New Brighton, Minnesota RE: Variance Application Dear Council and Planning Commission Members: We are .presently involved in negotiations for the purchase of a parcel of land located at 1155 Old Highway #8 in New Brighton, Minnesota. We had secured an option for purchase when we became aware of an unusual situation that could prevent us from using for our sales purposes approximately 1.05 acres of this property alone Old Highway #8. We were aware of the portion of the Zoning Code that required a 40 foot set back from the property line for any land use in a I-2 area. We were not aware of the Zoning Code that .indicated the front of a building in an I-2 zoned area became the set back line. The property we are considering has the office building set back 180 feet .from the property line and thusly, under the zoning code we must maintain this 180 foot set back even across the area in which we would want to park and display our sales trailers and lease trailers. Our sketch #4 shows the variance we are making application for and wev~uld like your .permission to observe a 40 foot set back on the portion of the property South of our driveway entrance. We would observe the 180 foot set back in the area in front of our office and would maintain this in grass, trees, and shrubs as our plan shows. We believe that the situation we are involved in is unusual and unique in this area. We would be allowed a 40 foot set back across the West edge of this property except that the office building was built 180 feet East of the property line. We feel that our 33 foot driveway does form a natural carrier and that the 40 foot set back could be allowed South of the driveway.
