Public, Hearing:
k VN-159
September 28, 1976
9015 P.M.-
Reguest:'~IN-159, Council approval of variance to permit a
driveway in a commercial district to exceed 36
feet in wdtho
Applicant: R.C.E.'Corporation
Location: 216:0 Silver Lake Road (Rice Creek Plaza)
Zoninq< B-3
Code Requirements:
Sections 1I-040 and 2-T00 state that the crucial points
of the variance are:
1. Undue hardship;
2. Unique circumstances, and;
3. Applying to property.
It is further stated that a variance is `not justified unless
all three elements are present in the case.:
Discussion:
The applicant has submitted an application for a building
permit to construct a neighborhood shopping center located,
west of Silver-Lake Road and south of Mississippi Street: As
discussed in the. report for LP-35, the applicant has-shown the
main driveway on Silver. Lake Road being forty-five (45~ ,feet
in width. The maximum-driveway width. allowed in commercia
districts is thirty-six (36) feet.
The applicant has indicated that the proposed driveway
width is essential to the access for the proposed shopping
center. The applicant has further- indicated that the drive--
way has been so designed on the recommendation of the Ramsey
'County Traffic Engineer.
As discussed in the LP-35 report, we have concerns for the
location 'of this driveway and for the general circulation off"
vehicles. Also,as;noted in the LP-35 report, it may be desr-
able to .conduct a traffic study to define the various al erna-
tives-.and solutions.
