Corp. <br />Sept. 28,.1976 <br />There is probably a superior land use and circulation plan <br />which could be adopted for the area but it would involve other <br />parcels not under the control of this applicant,` and would <br />involve substantial revision to the building configuration <br />proposed. <br />Basically we feed the proposed revision is acceptable <br />if the following_additonal concerns can be addressed: <br />1. written agreement. to provide access, via <br />the-33`-access easement off Mississippi <br />Street, to he undeveloped `parcel between, <br />the Super Value property and the veterinary <br />c binc <br />-2. Written agreement o provide;access for the <br />vacant service station property on-:.the corner <br />of,l~:ississippi Street and Silver Lake Road. <br />This may allow closing-of `some of the drive- <br />ways on 'that property at a future date. <br />The ..applicant: does not have it-in his power <br />to comply with this request since .the pro- <br />perty in question belongs to Erickson's <br />Super Va u. Raising thisquestion..atthis <br />time. might allow us, however, to approach <br />Erickson's and ettle this along with other <br />circulation issues. <br />3. Access to Rice Creek Road to be subject`to <br />further Council-approval prior to construction <br />of such .access. :The: developer and the owner <br />of the adjacent'propertyto the south .have an <br />oral agreement to provide :future access to <br />Rice Creek: Road.` We are not sure-at-.this <br />time `if that is or is not desirable but" <br />feel the`COuncil should retain the option <br />of:deciding this at-the tame it is,;proposed. <br />If the revised proposed plan is approved we would-suggest <br />that the easement agreements with Taco John's and Super Valu <br />.regarding access and the closing of`driveways on Silver Lake <br />Road be put into recordable documents approved ~y the City <br />Attorney and filed with the final plat.' <br />
