Request: vN-161, Council Approval of Variance to permit <br />floor-area-ratio to be increased over maximum allowed <br />by ordinance. <br />Applicant.: Spotts International <br />Location: 1300 Old Highway 8 <br />Zoning: I-1 <br />Code Requirements: <br />.Section 10-120 (f) states that in light industrial districts the <br />floor-area-ratio shall be a maximum of 0.3 for a one-.story building. <br />Section 2-700 'Variance, indicates that the necessary elements of the <br />variance request are: <br />1. Undue hardship. <br />2. Unique Circumstances, ands <br />3. Applying to property. <br />It is further noted that a variance is not justified unless all <br />three elements are present in the case. <br />Discussion: <br />Spotts International has filed a building permit application to <br />expand their most northerly building. The warehouse expansion <br />totals 44,160 square feet. The existing building has an area of <br />129,307 square feet. The total area of the property is 528,034 <br />square feet. The resultant total building area would create a <br />fluor-area-ratio of 0.33, which exceeds the above noted limits <br />for this light industrial district. <br />The applicant has indicated that because of the space needs they <br />have been forced to rent warehouse space in other facilities in <br />various locations (See Attached Application). The applicant has <br />also indicated that they would be better able to utilize their <br />property, that the proposed expansion would not be seen by the <br />general public and that the expansion will increase the tax revenue <br />for New Brighton. <br />Our primary concerns for this request are twofold: (1) Whether <br />the warrants are present to justify the variances and (2.) the extent <br />of the floor-area-ratio limit. <br />
