~ i <br />~~.,s~: l3~ARILVC <br />VN-161 <br />September 28, 19.76 <br />8:45 P.M< <br />Request: VN-161, Council Approval of Variance to ..permit <br />floor-area-ratio to be increased over maximum allowed <br />by ordinance. <br />Applicant: Spotts International <br />Location: 1300 Old Highway $ <br />Zonin~~ I-1 <br />Code Rectu irements : <br />Section 10-120 (f) states that in light industrial districts the <br />floor-area-ratio shall be a maximum of 0.3 for a one-story building. <br />Section 2-700 Variance, ndicates,tha the necessary elements of the <br />variance request are: <br />1. Undue hardships <br />2. Unique .Circumstances, and.,. <br />3. Applying to property. <br />`It is further noted."that a variance is not justified, unless all <br />three elements are present in the case. <br />Discuss-Toni`..: <br />Spotts International has filed a building permit application to <br />expand `their most northerly building. The warehouse expansion <br />totals 44,160 square feet.. The existing building has an area of <br />129,30? square feet.- The total area of--the-property._is 52.8,034. <br />square-feet. The .resultant total building area would create a <br />floor-area-ratio of'0.33, which exceeds the above noted limits- <br />for this light 'industrial district. <br />':Thee applicant. has indicated that because cf the space needs they <br />have been forced to rent warehouse space ~.n other faclines.n <br />various locations (See Attached Application). The applicant has <br />also indicated -that they would be better able to utilize their" <br />property, that the proposed expansion would not be seen by_the <br />general public and that the expansion will increase the tax revenue <br />for New Brighton. <br />Our primary concerns for this request are twofold: (1) Whether <br />the warrants are present to justify the variance; and (2) the intent <br />of the floor-area-ratio limit. <br />
