<br />VN--166 ~,~_ <br />of undue hardship and unique c;ircumst~nces must be present to <br />justify the- variance. <br />Thee-Zoning-Code regulates land use uniformally in specifying <br />minimum latwidths and areas. In this c?se, it is obvious: <br />that all Code rec{uirements could be satisfied if this,:parcel <br />were platted into only 3 lots. As the parcel can be platted <br />to meet all requirements, there may be a question of whether the <br />hardship is related to the land, apart from economic concerns <br />or desires. The uniqueness of .the property may also be questa:oned <br />as_ here are no existing-structures, marsh-areas, extreme topo- <br />graphical differences or irregular property lines. As noted, <br />the applicant has indicated that the property is unique in that <br />it`has:access-only off.of Sth St. This access; may be a valid: <br />concern. in. the discussion for PL-l08 it is noted that the <br />four.-lots. created would be extremely deep and that-this may not <br />be the most efficient use of land. It is further indicated in <br />that discussion that while acquiring additional land. or securing <br />access from Ilth Ave. may be preferable and may permit <br />more efficient .land use, those are factors. over v~hich the applicant <br />may-have little. control. <br />L <br />It should also be noted that both the Board of Planning and <br />the Mousing and Redevelopment Authority have been discussing the <br />inclusion in their plans of a policy calling fora new single <br />family-residence, zoning distris~,t that would require smaller lot , <br />areas and widths than the present ordinance. The intent is that <br />this district would be used in the older area of town where typical <br />lot sizes are smaller than the present ordinance requirement in order <br />to remove the need for variances in order to build on these lots. <br />Neither group has defined a specific area where this new zoning <br />district should apply.
