VN-166 <br />_2_ <br />of undue hardship and unique circumstances must be present to <br />justify the variance. <br />The Zoning Code regulates-land use uniformally in specifying <br />minimum lot widths and areas. In this case, it is obvious <br />that .all Code requirements could be satisfied if this parcel <br />were platted into only ~ lots. As the parcel can be platted <br />to meet all requirements, there may be a question of whether the <br />hardship is related to the land, apart from economic concerns <br />or desires. The uniqueness of the property may also be questioned <br />as there are no existing structures, marsh areas, extreme topo- <br />graphical differences or irregular property lines. As noted, <br />the applicant has indicated that the property is unique in that <br />it has access only off of 8th 5t. This access ma.y be a valid <br />concern. In the discussion for PL-108 it is noted that the <br />four lots created would be extremely deep and that this may not <br />be the most efficient use of land. It is further indicated in <br />that discussion that while acquiring additional land or securing <br />access from 11th Ave. may be preferable and may permit <br />more efficient land use, those are factors over cahich the applicant <br />• may have little control. <br />Additional comments regarding this request may be found in <br />the discussion for PL-108. <br />• <br />
