Swenson <br />Thomas, King, Swenson & Co1l.atz, P.A. <br />1100 Pioneer Building <br />St. Paul, NiI3 55101 <br />Re: Herbst & Sons, Ine. -Bernice Skiba Property Division <br />Dear Mr. Swenson: <br />At its February 22, 1977 meeting, the New Brighton City <br />Council adopted a resolution making Findings of Fact and approving <br />the variance application of Herbst & Sons, Inc. and Bernice <br />S1:iba in conjunction with the above noted property division. A <br />copy of this resolution (#1851) is attached for your records. <br />Please note the conditions under which the approval has been granted. <br />The Council also approved, by attached Resolution No. 1852, the <br />property subdivision. The procedure would be to have the appropriate <br />deeds prepared for review by the City Engineer. The City Engineer <br />must stamp the deeds verifying the lot descriptions before they <br />can be recorded with Ramsey County. <br />Our City Attorney has informed me that he has checked and <br />approved the form of the quit claim deed dedicating a thirty (30) <br />foot public road easement. When the City Attorney has received <br />proof of recording the quit claim deed, the City Engineer will be <br />able to stamp the property deeds so that they may also be recorded. <br />Should you have any questions regarding the Council action <br />or procedures mentioned, feel free to contact me. <br />Yours truly, <br />James F.
