Application <br />2. See enclosed landscape and plot plan <br />Code Requirements: <br />Section 10-090: <br />(b.) each building shall have a front yard <br />of not less than.th'irty;(30) feet in <br />depth. <br />Standards for Variance:' <br />Sections 11-040-and 2-700 state that the crucial-points <br />of the variance are: <br />1. Undue hardship <br />2. Unique circumstances, and <br />3. Applying to property <br />A variance is not justified unless all three elements are present <br />in the case. <br />Facts: <br />1. According to applicant's site-plan, canopy over the pump island <br />would extend to within 15 feet_:of their west property line <br />adjacent.to Silver Lake Road.; <br />2. Proposed canopy, is shown to be 24 x 65 feet. <br />3. Falcon oil is a self-serve gasoline dispensing operation. <br />4. The height of the 'canopy is'shown to be 13'6". <br />5. Applicant's reasonsfor requesting the variance are <br />attached to application form.
