_ __
RESOLUTION NO.
y
STATE OF MINNESOTA
~> COUNTY OF RAMSEY
CITY OF NEW BRIGHTON
RESOLUTION MAKING FINDINGS OF .FACT AND APPROVING APPLICATION FOR
VN-170
WHEREAS an application for variance entitled VN-170 has been
made by Dahlke Trailer Sales and Leasing, Inc., to allow erection
of signs exceeding Zoning Code requirements, and
WHEREAS, the procedural history of the application is as
follows :
1. That an application for VN-170 was .filed with the
City on February 9, 1977, and was heard and reviewed ',
by the Planning Commission at its meeting of
February 15, 1977;
2. That the City Council, pursuant to published and mailed
notices, held a public hearing on March 8, 1977 to
consider the application.. A 11 persons present at the
hearing an opportunity to be heard;
3. The written comments and analysis of the City Planner,
_ the Planning Commission minutes and recommendations,
and all persons' statements made at the public
hearing were considered.
NOW THEREFORE BE IT RESOLVED, That the New Brighton City
Council makes .the following Findings of Fact in respect to the
application for VN-170:
1. The recommended action does not grant Dahlke Trailer
Sales special privilege because the sign ordinance
anticipated the front of the building being the. face
with. the major dimensions. The applicant's building
has its front on the narrow side of the building,.
thereby creating a small. signable area.
2. The location and shape of both the property and building
present unique circumstances. regarding signing.
The property being situated near I-694, I-35W and Old
Highway 8 and the building having large setbacks from all
roads also presents unique circumstances. Further, the
narrow side of the building is the front side, which
way not anticipated by the ordinance.
3. A hardship exists for the signing of this property by
reason. of the unique circumstances noted above:
BE IT FURTHER RESOLVED, That the application for VN-170 be
hereby. approved for signing at 1155 Old Highway 8.
BE IT FURTHER RESOLVED, That the variance approved is subject.
to the following conditions:
