RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE <br />APPLICATION VN-177 <br />WHEREAS, an application for a variance VN-177 has been <br />made by Faith Christian Reformed Church, 1600 Silver Lake Road, <br />to permit the subdivision of lots having less than forty-five <br />(45) feet in width at the front lot line, and . <br />WHEREAS, the procedural history of the application is as <br />f o 1 lows : <br />1. That an application for variance VN-177 was filed <br />with the City on October 12, 1977 and was heard <br />and reviewed by the Planning Commission at its <br />meetings of October 16 and November 15, 1977; <br />2. That the City Council, pursuant to published and <br />mailed notices, held a public hearing on December 13, <br />1977 to consider the application. All persons present <br />at the hearing were given an opportunity to be heard; <br />3. The written comments and analysis of the City Planner, <br />the Planning Commission minutes and recommendations, <br />and all person's statements made at the public <br />hearing were considered. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of New <br />Brighton, that the Council hereby makes the following findings <br />of fact in respect to VN-177: <br />1. Unique circumstance is present because the cul- <br />de-sac was not installed deep enough into the <br />applicant's property; <br />2. Hardship is present because development of the <br />single lot would be uneconomical. <br />BE IT FURTHER RESOLVED, that the application for VN-177 <br />is and hereby approved subject to the following conditions: <br />1. That the applicant create and maintain a 10 foot <br />landscape strip including a 3-foot berm and <br />plantings between the church parking lot and the <br />two lots to be created; <br />2. That the applicant prepare and present an acceptable <br />drainage plan prior to final approval of the variance; <br />3. That the applicant provide a 10-foot snow storage <br />easement over the front of the two lots to be <br />created.
