ew <br />REPORT TO THE CITY COUNCIL <br />righton <br />Report #78-52 <br />March 7,.1978 <br />Application for Variance <br />VN-180 <br />March 14, 1978 <br />7:40 PM <br />PURPOSE: <br />Consideration of application fora sign variance. <br />BACKGROUND• <br />Applicant: .Doug Peterson <br />Location: 553-9th St. NW (South of 9th St. and west of <br />5th Ave.) <br />Zoning: B-3, General business <br />Code Requirements: <br />Section 14-150. Permanent Window Signs. Permanent <br />window signs are permitted in all but residential districts. <br />Permanent window signs may not in area exceed 25% of the <br />total arm of the window in which they are displayed. <br />The applicant's "Body Specialists" window sign was est- <br />ablished without a sign permit being issued. The sign is <br />at present illegal and non-conforming as a permit was not <br />issued and the sign occupies approximately 73% of the <br />window area. The "Whole Foods" sign (located in another <br />window of the building) has also been recently erected <br />illegally as a permit has not been. issued. The permit for <br />the "Whole Foods" sign cannot be issued until the "Body <br />Specialists" sign is legally established by means of the <br />variance as it exceeds 25% of the window area. <br />The applicant has chosen to identify his business through <br />the very elaborate window sign now established and has in <br />past, verbally indicated that this "Body Specialists" sign <br />was the extent of the signing he desired. To reduce the <br />"Body Specialists" to 25% of the window area would be both <br />time consuming and costly. The applicant has also indicated <br />that the logo and sign wording is essential as all of their <br />business forms and advertising contain the same inscription. <br />issued by City Manager <br />
