RESOLUTION NO. 7$-15 <br />.New Brighton Planning Commission <br />Board of Review <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF <br />VARIANCE APPLICATION VN-184 <br />.WHEREAS, an application for variance VN-184 has been made <br />by Keith T. Harstad to permit construction of a home having less <br />than the required basement floor elevation, and <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1.~ That an application far variance VN-184 was filed with <br />the City on May 10, 1978. <br />2. That the Board of Review heard and reviewed the <br />application at its meeting of May 22, 1978. <br />3. The written comments and analysis of the City Planner <br />and all person's statements made at the Board of Review <br />meeting were considered.. <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that t:~e <br />following findings of fact are made in respect to VN-184: <br />1. The lot in question meets all code requirements in <br />- terms of lot width and lot area. <br />2. The lot has a unique characteristic in that a large <br />part of the lot is occupied by two existing ponds. <br />3. Strict adherence to the ordinance requiring the lowest <br />floor elevation to be a minimum of 3 feet above the <br />regional flow .elevation may cause practical difficulties <br />or peculiar hardship for the applicant. <br />4. Adherence to a 929.00 elevation for the lowest floor <br />would secure the public health, safety and general <br />welfare while seeing that substantial justice is done <br />to the applicant. <br />
