RESOLUTION NO. ~$-15
New Brighton Planning Commission
Board of Review
RESOLUTION MAKING .FINDINGS OF FACT AND RECOMMENDING APPROVAL OF
VARIANCE .APPLICATION VN-184
WHEREAS, an application for variance VN-184 has been made
by Keith T. Harstad to permit construction of a home having less
than the required basement floor elevation,. and
WHEREAS, the procedural history of the application is as
follows
l.' That an application for variance VN-184 was filed with
the City on May 10,.1978.
. 2. That the Board of Review heard and reviewed the
application at its meeting of May 22, 1978.
3. The written comments and analysis of the City Planner_
and all person's statements made at the Board of Review
meeting were considered..
NOW THEREFORE BE IT RESOLVED by-the Board of Review that the
following findings of fact are made in respect to VN-184:
i. The Iot in question meets all code requirements in
terms of lot width and lot area.
2. The Iot has a unique characteristic in that a large
part of the lot is occupied by two existing ponds.
3. Strict adherence to the ordinance requiring the lowest
floor elevation to be a minimum of 3 feet above the
regional flow elevation may cause practical difficulties
or peculiar hardship for the applicant.
4. Adherence to a, 92g~.p6 elevation for the lowest floor
would secure the public health, safety and general
_ welfare while seeing that substantial justice is done
to the applicant.
r
F
