June 7, 1978 <br />REPORT TO THE .CITY COUNCIL <br />righton <br />Application for Variance <br />VN-185 <br />June 13, 1978 <br />PURPOSE 7:50 PM <br />To consider request for variance to. permit an`accessory <br />building exceeding 200 square, feet in area. <br />BACKGROUND <br />Applicants Gary & Ellen Huelsnitz <br />- Location: 2250 Mounds Ave.. (see attached location map) <br />Zoning: R-1, Single family <br />Comprehensive Plan (Draft): Single family. - <br />Ordinance Regulations: Section 13-030 (b) 2 <br />Accessory buildings, residential districts-states.. <br />that no accessory building, other than a detached <br />garage, may exceed two h"unfired (200) square feet. <br />in area. <br />The applicants have partially constructed a storage shed and <br />enclosed patio. The size of this accessory building, as noted <br />zn the. attached statement-from. the app icant is 12' x 30' or <br />3b0 square feet, which greatly exceeds .the size of accessory <br />buildings permitted, The site which .this accessory building <br />occupies was previously used•for an older tin shed and an <br />open air patio. <br />-.The applicants have addressed the warran s for a variance by <br />stating that the present structure is more attractive, is an <br />improvement to"the neighborhood, occupies. less-actual ground <br />space than the-old. shed-open airpatio., and.-is-well screened- <br />by existing ..landscaping .. <br />While the applicant's statements. are .true., it would appear- <br />that the reasons given would mitigate or lessen. the impact of <br />the variance but it is questionable whetherthey actually <br />,provide warrants (i.e., unique circumstances, undue hardship) <br />for the variance: If the variance were denied and the applica-~t <br />required to either remove or remodel the new shed-patio there <br />issued by City Manager <br />
