Report #78-I34
June' 7 ~ 1978
ew
REPORT TO THE :CITY COUNCIL
righton
Application for Variance
VN-185
June 13, 1978
.PURPOSE 7.50 PM
To consider request for variance to permit an accessory
building exceeding 200 square feet in area.:
BACKGROUND
Applicant: Gary & El-ten Huels»itz
Locations 2250 Mounds Ave. (see attached location map)
Zoning:, R-1, Single family
Comprehensive Plan (Draft): Single family.
Ordinance Regulations: Section 13-030 (b)` 2
Accessory buildings, residential districts states
that no accessory building, other than a detached.
garage, may exceed two hundred (2.00) square feet
in area.
The applicants have partially constructed a storage shed and
enclosed patio. -The size of this accessory building, as noted
in the attached statement from the applicant is 12' x 30' or
3b0 square feet, which greatly .exceeds the size of accessory
buildings permitted. The site which-this accessory building
occupies was previously used for an older tin. shed and an
open air patio.
The applicants have addressed the warrants fora variance by
stating that the. present structure is more attractive, is an
improvement to the neighborhood, occupies less actual ground
.space than the old shed-open air patio, and is well screened
by. existing landscaping.
While the applicant's statements are true, it would appear
that the reasons given would mitigate or lessen the impact of
the variance but it is questionable whether they actually
provide warrants (i.e.,: unique circumstances, .undue hardship)
for the variance. If the variance were denied and the applicant
required to either remove or remodel the new shed-patio there
issued by -.City Manager
