<br />NOTICE OF PUBLIC HEARING ON Request for a
<br />variance to permit a subdivision of property creating a
<br />lot not having frontage on a public streeYand being less
<br />than 75 feet in width.
<br />NOTICE IS HEREBY GIVEN that the New Brighton
<br />City Council will meet on Tuesday, July 25,1978, at f1:30
<br />o'clock p.m. at the New Brighton City Hall, New
<br />Brighton, Minnesota to consider: A request for a
<br />variance to permit a subdivision of property creating a
<br />'~ lot not having frontage on a pubic street and being less
<br />than 75 feet in width.
<br />Property Description: The west 1B0 feet Of the NW'd
<br />of the NW Vs Of Section 18, Township 30 North, Range Z3
<br />West, Ramsey County, Minnesota•lying southerly of the
<br />Minn. Transfer Railway Co. right-of-way. Except for a
<br />road easement over the west 33 feet (Stinson
<br />Boulevard) thereof and except for a 20 toot wide peM1
<br />manent sewer easement, the centerline of which begins
<br />at a point on the west Ilne of the NW +/, of the NW +/. Of
<br />Section 18 a distance of 5Y0.~7 feet south of the southerly
<br />right-of-way line of said railway, and thence extending
<br />in a southeasterly direction at an angle at 60 degrees ll'
<br />15",and except for a permanent road easement over the
<br />northeasterly 50 feet (Spring Creek Drive) and except
<br />for the Rfce Creek vicinity flowage easements and
<br />i except a 17 foot wide strip adjoining the Railway Co.

<br />and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the
<br />English language in newspaper format and in column and sheet form equivalent in printed space to at
<br />least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once rach week.
<br />(3) Said newspaper has 50 percent of its news columns devoted to news of local interest to the com-
<br />munity which it purports to serve and does not wholly duplicate any other publication and is not made
<br />up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near
<br />the municipality which it purports to serve, has at least 500 copies regularly delivered to paying
<br />subscribers, has an average of at least 75 percent of its total circulation currently paid or no more than
<br />three months in arrears and has entry as second-class matter in its local post-office. (S) Said newspaper
<br />purports To serve the Villaye of New Brighton in the County of Ramsey antl it has its known office
<br />of issue in the Village of New Brighton in said county, established and open during its regular
<br />business hours for the gathering of news, sale of atlvertisemenis and sale of subscriptions and main-
<br />tained by the publisher tlf said newspaper or persons in his employ and subject to his direction and
<br />control during all such regular business hours at which said newspaper is printed. (6) Said news-
<br />paper tiles a copy o1 each issue immediately with the State Historical Society. (7) Said newspaper has
<br />complied with all the foregoing conditions for at least two years preceding the day or dates of publi-
<br />cation mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior
<br />to January 1, 1966, and each January 1 thereafter an affidavit in the form prescribed by the Secretary
<br />of State and signed by the publisher and sworn to before a notary public stating that the newspaper is
