^ RESOLUTION NO. <br />New. Brighton .Planning.Commission <br />Board of Review <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING .APPROVAL 0 F <br />VN-189 <br />WHEREAS, an application for a variance VN-189 has been made by <br />Rollin Hansen to permit construction of a home with less than the <br />required thirty (30) foot front yard setback, and <br />WHEREAS, the procedural history of the application is as follows:. <br />1. That an application. for a variance VN-189--was filed. <br />with the City on July 12,.1978. <br />2. That the Board of Review heard and reviewed the <br />application at its meeting on July 31, 1978. <br />3. The written comments and analysis of the City Planner <br />and all persons' statements made at the Board of Review <br />meeting were considered. <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that the <br />following Findings of Faet are made in respect to VN-189: <br />1. That the property is zoned R-1, Single Family, which <br />requires a thirty {30) foot front yard setback. <br />2. That the development of this .lot has been affected:. <br />by the construction of an offset cul-de=sac and the <br />construction of a sound barrier. <br />3. That the ;conditions noted in 2. above-have created <br />unique circumstances pertaining to development of <br />the lot. <br />4. That conforming to ordinance requirements creates <br />problems for both the design and location of a home. <br />5. That construction of a home~meeting.setback require meets <br />could impact the privacy .and desirability of the su bject <br />lot as well as that of the adjacent property.' <br />
