RESOLUTION NO. <br />New Brighton Planning Commission <br />Board of Review <br />RESOLUTION IKAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL O F <br />VN-189 <br />WHEREAS, an application for a variance VN-I89 has been. made by <br />Rollin Hansen to permit construction of a home with less than the <br />.required thirty (30) foot front yard setback, and <br />.WHEREAS, the procedural history of the application is as follows: <br />1. That an application for a variance VN-189 was filed <br />with .the City on July 12, 1978. <br />2. That the Board of Review heard and .reviewed the <br />applicat-ion at its 'meeting on July 31, 1978• <br />3. The written comments and analysis of the City Planner <br />and all persons'-statements made at the Board of Review.: <br />meeting were considered.. <br />NOW THEREFORE BE IT RESOLVED by the-Board of Review that the <br />following, Findings of Fact are made in respect to VN-189: <br />1. That the property is zoned R-1, Single Family, which <br />requires a thirty (30) foot front yard setback. <br />2. That the"development of this lot has been affected <br />by the construction of an offset cul-de-sac and the <br />construction of asound barrier. <br />3. That the conditions noted in 2. above .have created <br />unique circumstances pertaining to development `of <br />the lot. <br />4. That conforming to ordinance requirements creates <br />problems for both the design and location of a home. <br />5. That construction of a home meeting setback requirements <br />.could impact the privacy .and .desirability of the subject <br />lot aswell as that. of the adjacent property. <br />
