~~~ <br /> <br />.,,~.:~a,.: <br />RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />.CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE <br />i APPLICATION VN-190. <br />if <br />WHEREAS, an application for a variance VN-190 has been <br />~~ <br />made by Mr. Gene Holen to permit the subdivision of property <br />ii <br />creating two lots that are less than 75 ft. in width and less <br />f than 10,000 sq. ft. in area, and <br />~; <br />,; <br />{ WHEREAS, the procedural history of the application is as <br />follows• <br />;; <br />I 1. That an application for a variance VN-190 was filed <br />~! with the City on July 12, 1978. <br />,: <br />ii 2. That the Board of Review heard and reviewed the <br />j? application at its meeting of July 31, 1978. <br />3. That the City Council, pursuant to published and <br />ii <br />~ mailed notice, held a public hearing on August 8, 1978, <br />'~ to consider the application.. Such hearing was. <br />ii continued. to August 8, to August 29, and again to <br />~~ September 14. A11 person's present at the public <br />I! hearing were given an opportunity to be heard. <br />I <br />~~ 4. The written. comments and analysis of the City Planner, <br />~~ the Planning Commission minutes and recommendation, <br />j and all erson's statements made at the <br />P public hearing <br />were considered. <br />±i NOW THEREFORE BE IT RESOLVED by the Council of the City of New <br />~! Brighton that the following Findings of Fact are made in respect <br />i ~ to VN-190 <br />;~ <br />;, <br />E 1. That the existing home is constructed very near the <br />~` south property line creating an extreme sideyard of <br />~; <br />74 feet on the north side of the home. <br />2. That this 74 foot sideyard. is a unique circumstance, <br />`' and not typical of other lots, <br />~: <br />(~ 3. That the present lot size and situation is .the result <br />of this area being previously platted into 40 foot <br />wide lots . <br />i; <br />°~ 4. That the lot sizes found within the .surrounding <br />j neighborhood present a unique circumstance in .that <br />~~ there is a mix of small and large lots. <br />~: <br />` 5. That all other zoning code requirements such as <br />setbacks and the floor-area-ratio, could be met <br />through the proposed subdivision. <br />j 6. That the home proposed to be constructed would be <br />compatible with the surrounding property. <br />~. <br />
