RESOLUTION NO. <br />NEW BRIGHTON PLANNING COMMISSION <br />BOARD OF REVIEW <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br />OF VARIANCE APPLICATION VN-194. <br />WHEREAS an application for a variance VN-194 has been <br />made by Mr. Allen McClintock, 2092 Thorndale Avenue, to permit <br />the construction of a garage having a 22.4 foot front yard <br />setback, and, <br />WHEREAS the procedural history of the application is as <br />follows: <br />1. That an application for variance VN-194 was filed <br />with the City on September 13, 1978. <br />2. That the Board of Review considered the application <br />at its meeting of September 19, 1978. <br />3. That the written comment and analysis of the City <br />Planner and all person's statements made at the <br />Board of Review meeting were considered. <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that <br />the following Findings of Fact are made in respect to VN-194: <br />1. That the property has some unique circumstances such <br />as a storm sewer easement along the eastern property <br />line, a steep slope from the front to rear of the <br />home and 4 large trees on the western side of the home. <br />2. That the circumstances noted. in 1 above create a <br />hardship in conforming to the required setback. <br />3. That the impact of the variance is lessened as a <br />result of the property being located on a cul-de-sac. <br />4. That the impact of the variance is lessened as a <br />result of the garage being designed to be architecturall <br />compatible with the existing home. <br />5. That the variance will not be detrimental to surrounding <br />property. <br />BE IT FURTHER RESOLVED that the Board of Review hereby <br />recommends that VN-194 be approved subject to the following <br />condition: <br />1.
