VN-196 <br />Carlson <br />Page #2 <br />The effect of a new home constructed on the proposed southern parcel <br />should also it would appear would have a minimal effect on the <br />property to the south as the proposed home to be built is according <br />to the applicant equal to the value or exceeds the value of many of <br />the homes in the area. The City Engineer has reviewed the topographical <br />data supplied by the applicant and it is his opinion that drainage <br />should not be a problem provided the lot is adequately graded. <br />The question of whether or not the warrants existed for subdividing <br />the property into twa lots having less than the required width also <br />was questioned at the Council public hearing. The applicant in his <br />statement has stated that while the lots will be slightly less than <br />the required 75 feet the overall area greatly exceeds that required <br />by ordinance. The applicant has further stated that the use of the <br />one parcel is impractical due to-its potential value. <br />The question whether or not warrants are present in this case is of <br />prime importance. In the past variances have been approved where a <br />lot had less than the reduced width but the overall area greatly <br />exceeded the minimum required by ordinance. This case presents that <br />situation where the area does exceed the minimum though in this case <br />a good portion of property is actually under water. The amount of <br />land above water is however still above the 10,000 square foot minimum. <br />This variance is also complicated in that the applicant is also <br />requesting a variance for not having frontage on a public street. <br />The applicant is attempting to rectify or remedy that situation by <br />dedicating a certain amount for road right-of-way. The trade off <br />proposed appears to be a good one as half the standard right-of-way <br />would be available if it were decided to install a public road going <br />north. At the same time the applicant could make a better utilization <br />of this very valuable Lake shore property. <br />RECOMMENDATION <br />Staff recommends that the VN-196 be approved by waiving the reading <br />and adopting the attached resolutior~ -- <br />r t~ .. <br />., /~ <br />~`~=" ~ <br />,,z~~mes F.
