Corporation <br />.LOCATION: West of Silver-Lake ROad, North of Ride Creek <br />Road and South of the Rice Creek Shopping <br />Center.. <br />ZONING: B-3, General Business <br />Approximately ten(10) weeks ago the City Council approved the <br />R,C,E. Corporation request for a temporary driveway from the <br />Rice Creek Center to Rice Creek Road. This approval, was given <br />subject to a one (1) year limitation on the use and location <br />of the driveway and also subject to condition that the. <br />operation of the driveway be reviewed after one year with <br />..consideration and Council action as to whether a second year <br />is permitted based on that review. <br />As this property. is zoned commercially there ..exists a require- <br />ment that the driveway servicing the shopping center be provided <br />with concrete curbs. Due to the temporary nature of this <br />driveway the applicant is requesting that he not be required to <br />install this concrete curb ing. <br />The application presents some circumstances that warrant <br />consideration of a variance. First, the situation is somewhat <br />unique in that the City Council has approved a driveway with <br />a condition that the driveway have a one year limitation with <br />a possibility of a second year. Sacondly, the installation <br />of the curbing could present a real hardship to the applicant <br />if' the driveway is no longer to be used after a period of one <br />.year in which case a considerable expense would have been wasted <br />~on the curbing. <br />issued by City Manager <br />
