CORPORATION <br />PURPOSE <br />Consideration of a request for a variance to not install concrete <br />curb adjacent to a drive way in a commercial district. <br />BACKGROUND <br />APPLICANT: R.C.E. Corporation <br />LOCATION: West of Silver Lake Road, North of Rice Creek <br />Road and South of the Rice Creek Shopping Center. <br />ZONING: B-3, General Business <br />Approximately six (6) weeks ago the City Council approved the R.C.E.. <br />Corporation request for a temporary driveway from the Rice Creek <br />Center to Rice Creek Road. This approval was given subject to a <br />one (1) year limitation on the use and location of the driveway <br />and also subject to condition that the operation of the driveway <br />be reviewed after one year with consideration and Council action <br />as to whether a second year is permitted based on that:-review. <br />As this property is zoned commercially there exists a requirement <br />that the driveway servicing the shopping center be provided with <br />concrete curbs. Due to the temporary nature of this driveway the <br />applicant is requesting that he not be required to install this <br />concrete curbing. <br />The application presents-some circumstances that warrant consideration <br />of a variance. First, the situation is somewhat unique in that the <br />City Council has approved a driveway with a condition that the <br />driveway have a one year limitation with a possibility of a second <br />year. Secondly, the installation of the curbing could present a <br />real hardship to the applicant if the driveway is no longer to <br />be used after a period of one year in which case a considerable <br />expense would have been wasted on the curbing. <br />RECOMMENDATION <br />Staff recommends that VN-197 be approved by waiving the reading and <br />adopting the attached resolution. <br />"Y < <br />ames F.
