RESOLUTION NO. <br />STATE OF MINNESOTA. <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING. DENIAL OF 1 <br />VARIANCE APPLICATION VN-198 <br />WHEREAS, an .application for Variance VN-198 has been made by <br />Mr. John Breen, 1100 2nd St. NW, to permit the construction of <br />a garage within one (1) .foot of .the.-side property line which,. is less <br />-than the required five (5) ..foot side setback requirement, and, ~ <br />WHEREAS, the procedural history of the application is as ~. <br />follows <br />1. That an application for Variance VN-198 was filed <br />with the City on .November 14, 1978. <br />2. That. the. Board of Review considered the application <br />at its meeting of November 21, .1978.. <br />3. That the written comments and analysis of the City <br />Planner and all person's statements made at the Boar'c <br />of Review meeting were considered. <br />NOW THEREFORE BE IT RESOLVED, by the Board of Review that the <br />following findings of fact are made in respect to VN-198; <br />1. That the lot size is comparable with other lot sizes <br />in the surrounding area. <br />2. That the garage can be constructed`to meet all code <br />requirements and still allow maximum use of the rear <br />.yard area. <br />3. That,the applicant has presented no warrants for the <br />Variance in terms of undue hardship or unique <br />circumstances and how they apply to the property. <br />I <br />BE IT FURTHER RESOLVED, .that the Board of Review hereby <br />recommends-that VN-198 be denied. <br />Adopted this 21st day of <br />November <br />1978. <br />Richard Brown, Chairman <br />ATTEST <br />Jo Archer, City Planner <br />
