'. <br /> <br />Council Meeting Minutes <br />July 28, 1987 <br /> <br />Halva stated, because of the Associationls by-laws, owners must be <br />notified of an open meeting to discuss a maintenance agreement or <br />the sale and the Board of Directors must vote (two-thirds majority <br />of the Board is required). <br />Benke asked if negotiations will be on-going; Halva indicated the <br />Associationls Board is willing to discuss the issues with McCalla. <br /> <br />To her knowledge, applicant Dolores McCalla, stated no one from <br />Windsor Green uses the road other than for maintenance; and refer- <br />red to several documents indicating her right to the easement. <br />Regarding liability, McCalla stated traffic on the road has <br />decreased rather than increased; and indicated she would be wil- <br />ling to sit down with Windsor Green to discuss the purchase of the <br />property. McCalla stated, from an economic standpoint, she needs <br />the eighth town home unit and did not feel her project should rise <br />or fall because of question of the road. <br /> <br />McCalla showed sketches of project building on 19% of the land and <br />noted she can blacktop as much as council feels necessary, but <br />stated it would detract from the overall appearance of the pro- <br />ject. Mr. Raag, the proposed projectls southerly neighbor, has <br />agreed the development can use his parking lot in the evening for <br />overflow parking in special situations. <br /> <br />Jens Beck, architect, briefly reviewed the plans for the project, <br />and pointed out that, as a result of reconfiguring floorplans, <br />window placement had changed. <br /> <br />Louis Jacobs, Windsor Green, stated pictures can be deceiving and <br />expressed concern that cars will park in the driveway which would <br />not leave sufficient space for emergency vehicles. <br /> <br />Beck stated every unit has a two-car garage and indicated there is <br />additional parking (for a total of almost four spaces per unit); <br />regarding fire access, reviewed the cityls fire code regarding <br />hydrants. McCalla stated units would not be large family homes <br />(two-bedroom, two-baths) so lot of parking space would not be re- <br />quired. <br /> <br />Benke stated it has been council IS experience that all legal dis- <br />cussion be concluded to everyone's satisfaction before council <br />gives approval; in order to arrange financing, McCalla asked that <br />the project not be delayed until an agreement on the easement can <br />be reached. <br /> <br />Benke advised council also needs to have the density issue resol- <br />ved because it is constrained by the language in the ordinance <br />which speaks to hardship; economic need or economic hardship is <br />not grounds for a variance; the Planning Commission has not been <br />able to document a hardship or a unique circumstance that applies <br />to the property. <br /> <br />Blomquist asked how many situations there are in the city where <br />access is by an easement, and whether or not such a situation is <br />lIunique;lI Locke indicated there are other situations in the city, <br />but was not aware of a number but would not consider it lIuniquell <br />under the definition for a variance request. <br /> <br />Page 6 <br />
