ew <br />REPORT TO THE CITY COUNCIL <br />Report #79- 349 <br />March 20, 1979 <br />Frighton APPLICATION FOR VARIANCE. <br />VN-201, LOWY ENTERPRISES INC <br />PURPOSE <br />To review.a request to permit a eight foot_high.chain link fence <br />in the front yard of a site in an industrial district. <br />BACKGROUND <br />APPLICANT: Lowy Enterprises, Inc. <br />LOCATION: 1565 First Avenue N.W. <br />ZONING: I-1, Light Industrial` <br />Lowy Enterprises Inc., is requesting a.variance to allow a 8' <br />high chain link fence in the front yard of their site. Section. <br />13-050 f. 1. states that: <br />"Fences erected in the front yard or on a street side <br />yard shall not exceed three and one-half (32) feet <br />in height and shall have at least seventy-five (75) <br />percent of their vertical surface plane open when <br />viewed from a point perpendicular to that plane." <br />The applicant indicates that in requiring a 3Z' fence there <br />would be a hardship for the applicant because of security and <br />insurance reasons (see attachment). The fence exceeds the <br />front building line for the purpose of securing the driveway <br />into the site by means of fencing and a security gate. <br />The security gate is located at the narrowest part of the <br />driveway and is 25' in length. If the fence would be restricted <br />to the front building line the gate would have to be <br />considerably larger at approximately 60' in length. <br />It should be noted that the fence is located in an area which <br />is below the front street elevation and does not cause any <br />traffic visibility problems. This variance request is within <br />the intentions of the zoning code in reference to variances <br />because of the security hardship that would result if the <br />applicant was restricted to a 33-2' high fence. In addition, <br />the fence has little visual impact and does not negatively <br />affect neighboring properties. <br />Issued by City Manager
