January 25, 1979 <br />~' <br />J~~''~~ <br />PURPOSE <br />This report reviews. a Council initiated, rezoning of certain property <br />in New .Brighton. <br />COUNCIL INITIATED REZONING <br />HOBAR< PUBLICATIONS <br />BACKGROUND <br />On January 23, 1979 the City Council reviewed a request by Hobar <br />Publications to rezone`a parcel generally located on the northeast <br />corner of .5th Street N.W.'and Old Highway 8 from I-2 to B-3. Staff <br />recommended. to the Council that rather than .rezone the.. one small <br />parcel, the Council should initiate rezoning of the area shown on <br />the'attached..map. <br />The Council, with the intentions of being consistent with the <br />proposed Comprehensive Plan, took action. to initiate the rezoning <br />of the Hobar property and, in addition, to initiate-the rezonngof <br />property to .the north, all the way to the railroad tracks, excluding <br />the City owned maintenance building site, from I-2 Heavy Industrial <br />to B-3, General Business. <br />All of this approximate 6 acres of property is proposed for. general <br />business uses in the Comprehensive Plan. The rezoning would not- <br />e make any of the existing businesses non-conforming. The property <br />immediately west of the railroad tracks is occupied with a single- <br />family dwelling that is a type II non-conformity under the present <br />I-2 zoning. While the rezoning to B-3 would not make this home a <br />..conforming use, it should be noted that the property owner has <br />indicated that he is interested in converting the property to'an <br />office use. <br />The other uses in the area proposed for rezoning would all be <br />permitted uses in a B-3, General Business District. These uses are: <br />a car wash, a car .wash parts sales, insurance agency, beauty salon, <br />small engine service, and a veterinary clinic. <br />The property across Old Highway #8 is zoned B-3, General Business. and <br />is accordingly developed.- Therefore, the rezoning would be compatiable <br />with-the surrounding land uses. <br />In summary this Council initiated rezoning would effectuate the <br />intentions set forth in the proposed land use section of the <br />Comprehensive Plan and would not make any of the existing uses non- <br />conforming.. <br />
