RESOLUTION NO. <br />NEW BRIGHTON PLANNING COMMISSION::. <br />BOARD OF REVIEW <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br />OF VARIANCE APPLICATION VN-204 <br />WHEREAS, an application for a Variance VN-204 has been <br />made by Omega Management Inc. to allow less than the required <br />side yard setback, less than the required buffer zone and <br />less than the required number of parking spaces. <br />WHEREAS, the procedural history of the application is <br />as follows: <br />1. That an application for a Variance VN-204 was filed <br />with the City on March 14, 1979. <br />2. That the Board of Review heard and reviewed the <br />application at its regular meeting on March 20, 1979, <br />3. The written comments and analysis of the City Planner <br />and all person's statements made at the Board of <br />Review meeting were considered. <br />NOW THEREFORE BE IT RESOLVED by the Board of Review <br />that the following Findings of Fact are made in respect <br />to VN-204. <br />1. The property is located in a B-1, Limited Business <br />district adjacent to a R-1, Single'Family <br />Residential District to the west and a R-2, <br />Two Family Residential district to the north. <br />2. The site is somewhat unique in its lot area with <br />two street frontages, and that it abutts <br />two residential districts. <br />3. The hardship of the applicant is that in order to <br />meet all zoning code regulations relating <br />to the property the buildable area of the lot is <br />substantially reduced. <br />4. The Comprehensive Plan designates adjoining <br />properties in a limited business land use category. <br />5. The applicant has provided for more than the <br />required landscaping if the adjacent property was <br />zoned commercial. <br />6. The applicant has provided for the maximum number <br />of parking spaces without infringing on the required <br />fifteen (15) foot side street yard setback and the <br />required thirty (30) foot front yard setback <br />landscaped area.
