., <br />VN-207 <br />Page #3 <br />Mr. McGinn stated that he formulated the proposed design to allow <br />privacy for each occupant of the dwelling and in order to save <br />the existing trees. <br />Mrs. McGinn remarked that she felt the code didn't allow for any <br />creativity in design. <br />Vice Chairman Williams stated that the Board: could choose from the <br />following alternative actions: <br />1, Recommend denial (staff's recommendation); or <br />2. Approve the request as submitted; or <br />3. Approve with .conditions; or <br />4. Continue discussion of the request to the .next meeting, <br />giving the Board additional time for .review; or <br />5. Send the request to the Council without a recommendation. <br />Motion by Williams, second by Baker to recommend approval of VN-207 <br />subject to the applicant adjusting his plans to allow for a side <br />street yard setback on 23rd Avenue NW of 15 feet. That the Board.. <br />recommends approval because of the following warrants: <br />1. That the unique circumstance is that it is.a corner lot <br />located adjacent to a R-1 district, and <br />2. That the Council when. the plat was approved established <br />that all dwellings would access :off of 14A Street NW; and <br />3. That an undue hardship would result if .the applicant moved <br />the house to comply with the front yard setback because. <br />the trees would have to be removed which would otherwise <br />have provided shade for the- house-and which would thus <br />conserve energy; and <br />4.
