VN-207
Page #3
Mr. McGinn stated that he formulated the proposed design to allow
privacy for each occupant of the dwelling and in order to save
the existing trees.
Mrs. McGinn remarked that she felt the code didn't allow for any
creativity in design.
Vice Chairman Williams stated that the Board could choose from the
following alternative actions:
1. Recommend denial (staff's recommendation); or
2. .Approve the request as submitted; or
3. Approve with conditions; or
4. Continue discussion of the request to the next meeting,
giving the Board additional time for review; or
5. Send the request to the Council without a recommendation.
Motion by Williams, second by Baker to recommend approval of VN-207
subject to the applicant adjusting his plans to. allow for a side
street yard setback on 23rd Avenue NW of 15 feet. That the Board
recommends approval because of the following warrants:
1. That the unique circumstance is that it is a corner lot
located adjacent to a R-1 district, and
2. That the Council when the plat was approved established
that all. dwellings would access :off of 14A Street NW; and
3. That an undue hardship would result if the applicant moved
the house to comply with the fnont yard setback because
the trees would have to be removed which would otherwise
have provided shade for the house and which would thus
conserve energy; and
4. That the side yard setbacks total 50 feet and this reduces
the buildable area of the lot to 50 feet which results in
an undue hardship in terms of creative design.
Motion by Baker, second by Williams to amend the motion to include
another finding that this design is unique and provides for a 30
foot driveway.
4 Ayes - 0 Nayes, amendment carried.

icertifythatl~a~es - 0 Nayes, motion as amended carried.
tevtewedthis Se~~rF~n RECOMMENDATION
have:
~r
D
._
ate
No~~~~nt~"~ommends that the City deny ~-:vari ance application VN-207
sur:.W_•atitaa ng the reading and adopting the attached resolution making
tec~fi~dd~,g~n•of fact and denying VN-207.
Attached wr~tt?n .
comments to
supplement the
ecommenGa;ian.
ZwM ~- -
Cit~ a~~;~;;;;r
/!!•
o n M.
