November 21, 1980 <br />Mr. Bill Dircks <br />Berger Transfer & Storage, Inc. <br />3720 NE Macalaster Drive <br />St. Anthony, Minnesota 55422 <br />RE: Administrative Agreement Concerning Temporary Driveway <br />Dear Mr. Dircks: <br />On November 20, 1980 the Building Official and myself met <br />with Hank Murlowski and Paul Luxem at your new site on Old <br />Highway #8 in New Brighton. The purpose of the meeting was <br />to determine the items that are to be completed before a <br />final certificate of occupancy could be issued by the City <br />of New Brighton. <br />The required letter of credit and $50.00 fee will be provided <br />and Ron Nienaber, Building Offici.al will then issue the <br />temporary certificate of occupancy. The temporary certificate <br />will allow you to'occupy the building and will give your <br />contractor 9 months to complete the required site work. <br />There is one issue yet to be resolved and this is the purpose <br />of my letter and attached agreement. The. site and landscape <br />plans and floor plans approved by the City Council indicate <br />that the area west of the building will be landscaped and does <br />not depict the overhead door that was constructed. In <br />examining the plans approved by the Building Official the <br />overhead door is depicted on the west elevation of the <br />building. <br />The overhead door was constructed and a temporary driveway <br />off of 3rd StrRet SW was installed. The site was only approved <br />for three driveways and I cannot administrtively approve the <br />fourth driveway. On November 20, 1980 during the meeting at <br />the site a compromise was reached which I feel as staff I can <br />support on a temporary basis. This proposal is outlined on <br />the attached agreement and I request that you as property <br />owner sign the agreement.
