I

RESOLUTION NO
NEW BRIGHTON PLANNING COMMISSION
BOARD OF REVIEW
RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL
OF APPLICATION FOR VARIANCE, VN-212
WHEREAS, An application for a variance, VN-212 has been
made by Berger Transfer and.Storage, Inc..to permit the
installation of a 6 foot high fence in a side street yard of
an industrial site; and
WHEREAS, The procedural history of'the application is
as follows:
-1. That an application for a variance, VN-212 was filed
with the City on October 1, 1979.
2. That the Board of Review heard and reviewed the
application at its regular meeting on November 20, 1979
3. The written comments and analysis of the City Planner
and all-person's statements made at the- Board of
Review meeting were considered.
NOW THEREFORE BE IT RESOLVED by the Board of Review that
the following Findings of Fact are made in respect to VN-212;,
1. That the site is located in a I-2,.Heavy Industrial
zoning district.
2. That the site is unique in that it is enclosed on all
sides by public street.
3. That a six foot fence is.necessary-for security and
a hardship would result if the zoning code was
literally enforced only allowing the applicant a fence'
of 32 feet in height.
3. That the fence is an opaque chain.link fence which
will not impair the visibility of persons traveling
on adjacent public streets.
4. That the proposed fence will be setback on the inside
of the berm and landscaping and therefore will not
create an appearance that would adversely affect
adjacent property owners and would be consistent with
similar security -fences in that area.
BE TT FURTHER RESOLVED, That the application for VN-212
is hereby recommended for approval subject to the following
conditions:

1. That the fence w i-11 be installed in conformance with
the modified site plan signed and dated by the
applicant and City Plann-er;
2. That the fence will be opaque and will not have slats
that would interfere with traffic visibility
adversely; and
3. That the fence will be well maintained and kept in
repair.
Adopted this day of 1979.
Steven Schmidt, Chairman
Joan M. Archer, City Planner
