RESOLUTION NO

STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR
VARIANCE APPLICATION, VN-215
WHEREAS, An application for a variance entitled VN-215 has
been made by Belair Builders Corporation to allow the constru.cti
of an industrial building with less than the required side yard
setback; and
WHEREAS, The procedural history of the application is as
follows:
1. That an application for variance, VN-215 was filed with
the City of New Brighton on August 8, 1980.
2. That such application was reviewed by the New Brighton
Planning Commission Board of Review on August 19, 1980
and September 16, 1980.
3. That the'City Council, pursuant to published and mailed
notices, held a public hearing on September 23, 1980, all
person's present at the hearing were given an opportunity
to be heard.
4. The written comments and analysis of the City staff, the
Planning Commission minutes and recommendations were
considered.

9
NOW THEREFORE BE IT RESOLVED, That the New Brighton City
Council makes the following Findings of Fact in respect to VN-21 ;
1. That the property is zoned I-1, Light Industrial;
2. That the lot is only 75 feet in width, which is a
relatively narrow lot width in an industrial district;
3. That the proposal-will be removing a single family home
which is a Type II non-conformity;_
4. That a hardship would result if the driveway width is
reduced because it would not be adequate for industrial
vehicles;
5. That a lesser width for the proposed builidng would deter
from the functional use of the building; and
6. That the applicant has attempted to purchase additional'
property to alleviate the need for a variance.
BE IT FURTHER RESOLVED, That the City Council hereby approves
variance application, VN-215 contingent on the following
conditions:
1. That scrubs or other types of landscaping be installed
along the 5 foot side yard to accent the building and
break up the appearance of the building.
2. That there be no outside storage of parts, debris and
that.all vehicles are currently licensed and operable.
3. That the building be setback a minimum of fifty feet
from the street right-of-way.
Adopted this day of 1980.
James W. Senden, Mayor
