STAFF COMMENTS <br />APRIL 1977 - The City Council adopted.a resolution approving a variance <br />• for the construction of the Rice Creek Center. One of the <br />conditions of approval is: <br />"8. That access to Rice Creek Road be subject to Council <br />review and control at the time the commercially zoned <br />property south of the shopping center is developed." <br />AUGUST 29, 1978 - City Council approved request for driveway to Rice <br />Creek Center with the following conditions: <br />1. That the temporary driveway be permitted for one (1) <br />year period or until the commercially zoned property <br />to the south is developed, whichever is shorter. <br />2. That the driveway surface be of asphalt, with a mat <br />12" to 2" in depth. <br />3. That the driveway in all other respect conform to <br />all city ordinances or to any variances if granted. <br />4. That any future permanent or temporary driveways <br />or roads on this property shall be subject to City <br />Council approval. <br />5. The driveway is subject to review after one (1) year. <br />JANUARY 13, 1981 - City Council approved a variance VN-217 to allow the <br />construction of the addition to the shopping center. The <br />Council resolution #2407 approving VN-217 has the <br />• following condition in regard to the driveway: <br />"3. That the driveway off of Rice Creek Road be considered <br />temporary in nature but be maintained by the applicant <br />and be repaired and have a 2 inch bituminous surface <br />before a certificate of occupancy is issued for the <br />addition." <br />MAY 12, 1981 - Mr. Ernst changed the location of the expansion building <br />and Council approved that change subject to a number of <br />conditions, one being: <br />"1. Conformance with Council Resolution #2407 approving <br />VN-217;" <br />SEPTEMBER 9, 1981 - Mr. Ernst applied for a building permit from the <br />Building Official for the addition. City Planner <br />memorandum received by Mr. Ernst stated the items to be <br />addressed prior to permit issuance: <br />"6.
