Fornell, City Manager <br />EXPLANATION/SUMMARY (attach supplemental sheets as necessary): <br />EXPLANATION <br />R.C. Ernst has submitted the attached letter requesting an extension of <br />a variance condition for the temporary driveway going into Rice Creek <br />Center. The variance was approved last January while construction on <br />the addition started in September. <br />The basis of this request is that discussions have and are being held <br />regarding the construction of a new Super Valu store on the property <br />located south of the shopping center addition and west of the Dairy <br />Queen, Lund Realty and Taco John's property. This new development <br />according to Mr. Ernst could begin construction as early as April, 1982. <br />Mr. Ernst is requesting the extension at this time because he wants to <br />occupy portions of the new addition in early January, 1982. If the <br />extension were not approved we would withhold the certificates of <br />occupancy. <br />This particular condition regarding the temporary driveway has been known <br />for almost the entire year and the date when occupancy was possible <br />should have been relatively easy to calculate. Therefore, it is <br />difficult to understand why the work has not been completed. At this <br />time of the year it is also not realistic to talk about putting down a <br />2 inch bituminous surface. If in fact the Super Valu development occurs <br />the expenditure to temporarily repair the driveway would be wasted. The <br />money could be better spent on site improvements for the new development. <br />(continued) <br />RECOMMENDATION <br />To grant an extension for completion of the temporary driveway at Rice <br />Creek Center until June 1, 1982 and to direct staff to issue a final <br />certificate of occupancy only when the driveway issue has been resolved. <br />F.
