RESOLUTION NO. <br />0 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR VARIANCE, <br />VN-218 <br />WHEREAS, An application for a variance entitled VN-218 has been made <br />by Chemical Technology Inc., to allow less than the required front yard <br />setback; and <br />WHEREAS, The procedural history of the application is as follows: <br />_1. That an application for variance, VN-218 was filed with the City <br />of New Brighton on November 11, 1980.- <br />2. That such application was reviewed by the New Brighton Planning <br />. Commission Board of Review on November 18, 1980. <br />3. That the City Council, pursuant to published and mailed notices, <br />held a public hearing on December 9, 1980, all person's present at <br />the hearing were.given an opportunity to be heard. <br />4. The writtem comments and analysis of the City staff, the Planning <br />Commission minutes and recommendations were considered. <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City Council makes <br />the following Findings of Fact in respect to VN-218: <br />1. That the property is zoned, I-2 Heavy Industrial; <br />2. That the building was built according to a certificate of survey <br />and a temporary certificate of occupancy was issued on the basis <br />of that original survey; <br />3. That a second survey was conducted which denoted an error-in the - <br />original survey and that the constructed building was in error; <br />-4. That a hardship would result for the property owner if the property <br />owner is required to relocate the building. <br />BE IT FURTHER RESOLVED, That the application VN-218 is and hereby <br />approved subject to the following conditions: <br />1. That the landscape plan approved under LP-83 be revised to <br />include additional plantings in the front yard; and <br />2. That the applicant grant the City of New Brighton a permanent <br />utility easement across the northern 20 feet of both the applicant': <br />parcels. <br />Adopted this day of 1980. <br />ATTEST: <br />James W.
