<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />March 24, 1987 <br /> <br />Schmidt questioned how staff and Miller & Schroeder are trying to <br />structure the development agreement so whatever we will have to <br />pay for the land will be covered in that agreement; Locke stated <br />the city needs to be cautious about what it will pay for the prop- <br />erty and that information should be included in the agreement. <br /> <br />If we adopt the quick take proceeding resolution and then the <br />development agreement is not approved at the next council meeting, <br />Schmidt asked if we have then purchased a piece of land that we <br />must pay for, although we do not have a guaranteed project. <br /> <br />Locke stated it is conceivable we could own the land without a <br />project, although we would not have title until 90 days after the <br />filing of the petition of quick take proceedings which is the key <br />step, rather than council action, to irreversibility. <br /> <br />Benke asked if the intent is to then withhold the filing of the <br />petition until a development agreement is executed; Locke felt we <br />should move ahead because it is very difficult to put together a <br />development agreement without having some certainty about delivery <br />of the land. <br /> <br />LeFevere concurred with Locke's thoughts; and stated until title <br />of possession is transferred, the city can abandon a project but <br />you run up legal fees until the time of the abandonment and those <br />costs will grow with time. LeFevere further indicated it is not <br />in the city's control how fast the proceedings will be accomplish- <br />ed. <br /> <br />Locke felt confident there would be a proposal for one of the two <br />sites at the next council meeting (April 14, 1987). <br /> <br />Motion by Gunderman, se~onded by Williams, to WAIVE THE READING <br />AND ADOPT A RESOLUTION AUTHORIZING ACQUISITION OF TITLE AND <br />POSSESSION TO CERTAIN LANDS TO BE ACQUIRED BY EMINENT DOMAIN <br />PURSUANT TO MINNESOTA STATUTES SECTION 117.042 RESPECTING <br />DEVELOPMENT DISTRICT NO.1 (Gordon Hedlund property). <br /> <br />Concerned about the remaining parcels of Leier Estates because of <br />the configuration of land and the poor soils, Williams asked if it <br />would make economic sense to acquire the whole area, replat it if <br />necessary, and remarket it in usable form. Williams also asked if <br />there would be an economic value for the city if the problems of <br />the land would lower the overall unit price of the land. <br /> <br />Page 10 <br />
