RESOLUTION NO <br />STATE OF MINNESOTA <br />COUNTY OF RAP4SEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR VARIANCE, <br />VN-221 - { <br />WHEREAS, an application for a variance entitled VN-221 has been made by <br />the City of New Brighton. to permit the construction 'of an addition with less <br />than the required number of parking spaces; and <br />WHEREAS, the procedural history of the application is as follows: <br />7. That an application for a variance, VN-221 was filed with the City <br />of New Brighton on June 16, 1981. <br />2. That such application was-reviewed by the New Brighton Planning <br />Commission Board of Review on June 22, 1981. <br />3. That the City Council, pursuant to published and mailed notices, <br />held a public hearing on July 14, 1981, all.-person's present at the <br />hearing were given an opportunity. to be heard. <br />4. The written comments and analysis of the City staff, the Planning <br />Commission minutes and recommendations were considered. <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City Council makes <br />the following Findings of Fact in respect to UN-221: <br />1. That the property is zoned B-3, General Business; <br />2. That the existing store was developed and designed as an integral <br />part of the Brighton Village Shopping Center in terms of access and <br />parking according to a 1972 agreement; " <br />3. That Section 12-050 m. provides for an allowance for-joint use of a <br />parking area; <br />4. That the shopping center according to the requirements of the New <br />Brighton Zoning Code has a surplus of 105 parking spaces; <br />5. That the actual parking demand for. the existing off-sale liquor <br />store is minimal and of the short-term. variety and therefore should <br />complement-the-parking demand created by the proposed on-sale <br />operation; <br />6. That the site is unique from restaurant= park~in:g, demands and therefore. <br />the zoning code-parking requirements do not specifically apply`; <br />7. That the site is also unique in being a part of a shopping center <br />in that there is an existing joint use parking agreement and that <br />the two functions are not segregated in design; <br />8. That a hardship would result in restricting development of the site <br />by not giving consideration for the use of the adjacent parking <br />spaces`.~that~ a.re presently bei ng ~ used .~under.-.;the ~ ski s ti ng jo.i nt parking <br />agreement. ~ ~ " <br />BE IT FURTHER RESOLVED that the application for variance, VN-221 is and <br />hereby approved subject to the following conditions: <br />1. That the applicant provide a new"joint parking agreement with the <br />owners of the shopping center for overflow parking; <br />2. That the Liquor Director periodically monitor the parking situation <br />and the City review the parking situation one year after the. <br />issuance of a Certificate of Occupancy; and <br />3. That the internal circulation patterns and traffic mechanisms on the <br />two sites be analyed and approved by :the City Engineer.. <br />Adapted this day of , 1981• <br />
