PURPOSE <br />APPLICATION FOR VARIANCE <br />VN-222 McCALLUM <br />To consider a request for a minor subdivision creating .five (5) <br />lots, 1-lot with less than the required width. <br />BACKGROUND <br />APPLICANT: <br />LOCATION: <br />EXISTING ZONING: <br />PRESENT USE OF PROPERTY: <br />PROPOSED USE OF PROPERTY: <br />CODE REQUIREMENTS: <br />APPLICANT'S PROPOSAL <br />Lois McCallum <br />1440 West County Road "D" <br />Generally located south of 7th <br />Street SW, north of County Road. <br />"D", west of McCallum Drive, <br />and east of Continental Drive. <br />R-1, Single Family Residential <br />Single Family Residence <br />Five (5) Single Family Lots <br />Section 26-24 of the New Brighton <br />Subdivision Ordinance. provides for <br />the subdivision of property without <br />platting on the basis of smallness <br />in size and a well-defined area. <br />The zoning code requires single <br />family lots to be 75 feet in width <br />at the building setback and 10,000 <br />square feet in area. <br />The applicant is proposing the <br />minor subdivision to subdivide a <br />single family lot into five (5) <br />single family lots. <br />The applicant is requesting a <br />variance on the basis that the one <br />(1) lot on County Road "D" has a <br />width of 72 feet rather than the <br />required 75 feet. The applicant <br />has noted that the rationale for <br />the variance is that there is an <br />existing house on the property which <br />precludes the subdivision of the <br />proposed lots on County Road "D" <br />into lots with 75 feet in width. <br />The hardship as indicated by the <br />applicant would be the result of <br />two (2) lots excessive in size <br />rather than the three (3) as <br />proposed. In addition, the <br />applicant states that the situation <br />is somewhat unique by .the fact that <br />the property contains an existing <br />single family home.. <br />
