HEAD'S APPROVAL: ~ L LL~ ~L- <br />MANAGER'S REVIEW/RECOMMENDATION: <br />No comments to supplement this report ~ ~ Comments below/attached <br />EXPLANATION/SUMMARY (attach supplemental sheets as necessary): <br />SUMMARY <br />APPLICANT: City of New Brighton <br />LOCATION: Well #10 - South of Jones Lake <br />Well #11 - 7th Street NW & Hansen Park <br />ZONING: Well #10 - I-1, Light Industrial <br />Well #11 - R-1, Single Family Residential <br />1. Well #10 - To construct a building to house the well and iron removal equipment. The <br />reason for the variance request is that the zoning code requires a 60 foot setback 'I <br />from residential districts and the building is only 50 feet from the west property <br />line. The unique circumstance is that the City has to construct this new well in <br />response to the water contamination problem. The undue hardship facing the City is <br />that the Minnesota Health Department will only approve this location because of <br />State distance requirements from the water tower and underground storm sewer pipes. <br />To meet zoning code requirements the City would be forced to select another site or <br />purchase additional property which would be an undue hardship. The impact of the l0 <br />foot variance request is lessened because the west property line of the adjance <br />property consists of a row of garage buildings for the apartment complex. The 10 <br />foot variance will not have a negative visual impact nor create any safety problems <br />for adjoining residents. <br />2. We71 #ll - To construct a structure off of 7th Street NW on City owned property <br />adjacent to Hansen Park to house Well #11 and the iron removal equipment. The <br />construction is a part of the solution to the City's water contamination problem. <br />RECOMMENDATION <br />To waive the reading and adopt the attached Resolution approving VN-225; and <br />To approve by simple motion LP-736 and LP-138 subject to the fo77owing: <br />1. That final plans be approved by Rice Creek Watershed District and City Engineer; <br />2. That there is conformance with site and landscape plans. <br />. Hrcner, city Ntanner <br />
