Your site lies within the shoreland district <br />of Long Lake in that it is within 1000 feet of the normal high watermark of <br />the Lake. <br />I•iinnesota Statutes, Section 105.485 provides for municipal control of shore- <br />lands through adoption of ordinance, rule, or re511ation. The legislature <br />failed to provide funding or staffing to this Department in order to imple- <br />ment this program. State regulations for municipal shoreland management <br />were promulgated in 1976 and since that time we have been requiring munici- <br />palities to adopt compliant controls on a priority basis. New Brighton is <br />a mediur priority and, to date, we have not required that shoreland manage- <br />ment controls be adopted. iti'e have provided the City with the necessary <br />infor,:,ation and reco:-^nended that they adopt controls. The City took action <br />to do this in 1978-7g but the City Council voted not to adopt controls in <br />e.'-rl;' ~g7°. Until the City adopts such controls, our regulations are only <br />in the form of recor-~ended standards. <br />If your project would alter the course, current, or cross-section of Long <br />Lake or any protected waters or wetlands, a permit from this Department <br />would be required for such alterations. If the existing well on the <br />property is going to be used, a water appropriation permit will be required <br />if you appropriate tyre than 10,000 gallons per day or one million gallons <br />per year. <br />AN EQUAL OPPORTUNITY EMPLOYER <br />
